$1.45 Million Wrongful Death Settlement Reached: Patient's Chart Was "Lost" By Hospital

August 10, 2004, - Rapoport Law Offices, P.C. announced today that it reached a $1.45 million settlement on behalf of the family of a 46 year-old unemployed, single female with no children, who died at a local hospital under suspicious circumstances. Following her death multiple requests were made by her family for her medical records. The hospital claimed to have lost the medical records after they were "checked out for medical studies"

After a lawsuit was filed for wrongful death, a large portion of the patients chart was reconstructed from the hospital computer system and from the hospital pharmacy that stored copies of the physician orders. An attorney for the plaintiff commented, "The physicians misrepresented this patient's cause of death as listed on the death certificate. Instead of dying from dead bowel as her physicians claimed, the records we were able to dredge up show this patient died from a preventable pulmonary embolism, which exhibited signs and symptoms of its presence in the days before her death. The disappearance of the records was very suspicious."
