$5 Million Settlement for Families of Victims of Trucking Accident
July 2005 - An aggregate settlement of five million dollars was reached on behalf of the families of two men who suffered fatal injuries in an accident along Interstate 80 in Iowa. The men were random victims when their respective vehicles, which were traveling westbound on Interstate 80, were struck by a trailer which broke away from the semi-tractor that was pulling it and crossed into their lane of traffic at high speed. The trailer which broke away had no suspension for over the road driving and no trailer brakes. The tow bar on the trailer was completely fractured just behind the point on the tow bar where the safety chains were attached. The lawsuit alleged that reasonable visual inspection would have revealed the presence of cracking severe enough to render the tow bar defective and unusable. The plaintiffs claimed that the defendant negligently failed to properly maintain its trailer and the driver negligently operated an unsafe vehicle on the highway in violation of federal regulations.
