$2.9 Million Settlement: Wrongful Death of a Baby as a Result of Brain Injury
March 15, 2005 - A $2.9 million dollar settlement was reached today for a client of Rapoport Law Offices P.C. whose one year old baby died as a result of injuries sustained at birth.
The baby was born sick and depressed at a Chicago area hospital. He was resuscitated and transferred to a neonatal intensive care unit where he stayed for one month. The infant was then transferred back to the hospital at which he was born. He was in and out of the hospital until his death, shortly after his first birthday.
Rapoport Law Offices, P.C. conducted an investigation into this matter which included experts in five different fields of medicine. The results revealed that the baby died from complications associated with brain damage incurred at or near his birth. Attorney Jon C. Papin explains, "Our investigation concluded that the baby's fetal heart strips were non-reassuring for more then one hour before physicians recognized the problem. By then it was too late."
