A person doesn't need to figure out whether theirs is a case that should or shouldn't have a trial lawyer. They should talk to trial lawyers.
Someone doesn't need a lawyer if they can keep more money without a lawyer than they're likely to get with one. Sometimes the case value is so small that the cost of winning the case to the insurance company is more than the cost of the insurance company getting that case off the books.
