Judge Sets July Trial Date For Second Phase Of Comair Flight 5191 Trial

United States Senior Judge Karl S. Forester has set a July 19, 2010 trial date for the punitive damages phase of the lawsuit filed against Comair by the wife and daughters of Bryan Keith Woodward, who was killed when Comair Flight 5191 crashed in August, 2006 at Blue Grass Airport in Lexington, Kentucky. The compensatory damages portion of the litigation concluded in December, 2009 with a $7.1 Million verdict awarded to the plaintiffs.

The punitive damages trial will focus on the plaintiffs’ allegations that the crash of Flight 5191, which killed 49 of the 50 people on board, was caused by gross negligence on the part of Comair. Flight 5191 crashed into a field adjacent to the airport shortly after the pilots attempted to take off from a runway that was too short for a commercial jet.

After the verdict was reached in December in the compensatory damages phase, Comair moved for a new trial, and also requested a reduction in the amount of damages awarded to Mr. Woodward’s two daughters. The court denied both of those requests earlier this month.
